Malpractice is the general term which is applied to negligent conduct on the part of a doctor, dentist, lawyer, hospital, or other members of a given profession. Negligence means that someone either performed an act in a less than competent manner or failed to perform an act that a reasonable professional would have performed. The Pennsylvania Workers' Compensation laws provide benefits for employees who are injured or develop a disease related to their employment. Workers' Compensation is administered by the Bureau of Workers' Compensation of the Department of Labor and Industry in Harrisburg, Pennsylvania. As a general rule, unless a binding employment contract exists, employment in Pennsylvania is presumed to be “at-will” and may be terminated by either the employer or the employee at any time and for any reason, so long as it does not violate applicable law. Both state and federal law makes it illegal to discriminate on the basis of race, color, religion, age, sex, national origin, ancestry, and in some cases, disabilities. Erie County, Pennsylvania, also has regulations prohibiting discrimination on the basis of sexual orientation. The Americans with Disabilities Act, or ADA, was enacted into law on July 26, 1990, and completely effective on July 26, 1994. The ADA has been described as the most significant human rights legislation to be enacted by the federal government in at least the past 20 years. The ADA is organized into five sections covering various topics related to Americans with disabilities. The Fair Labor Standards Act guarantees most employees minimum wage and overtime pay benefits. Currently, the minimum wage is $7.25 per hour. Employees may be paid an hourly rate, a fixed weekly salary, or a fixed monthly or semi-monthly salary so long as the employee is paid at least $7.25 for each hour worked. Emancipation is a process by which a child under the age of 18 reaches at least some level of legal adulthood. There are two sides to emancipation: (1) the ending of parental responsibilities to a minor child and (2) the transfer of rights and responsibilities of adulthood to a minor child. In Pennsylvania, a delinquent act is a crime other than murder and summary offenses, committed by a person under 18 years of age. In addition, the Juvenile Act gives Juvenile Court jurisdiction over those persons between the age of eighteen and twenty-one who are alleged to have committed a delinquent act before their eighteenth birthday. When buying a used car, you should always shop around and take time in choosing your car. You should take the vehicle for a test drive, allowing the vehicle to reach a normal operating temperature. Many problems are not apparent in a short trip around the block. You should also have your own mechanic check the vehicle. The Pennsylvania Lemon Law applies to any new vehicle leased or purchased and registered in Pennsylvania. It applies only to vehicles leased or purchased for personal or family use and designed to transport up to fifteen persons. Motorcycles, motor homes, and off-road vehicles are not included. There is no Lemon Law protection for used vehicles.
